Terms and Conditions of Use
National Digital Alphanumeric Postcode System (NDAPS)
1. Agreement of terms
1.1 NDAPS means the National Digital Alphanumeric Postcode System operated, administered or authorized by NIPOST, including its associated databases, applications, websites, APIs, infrastructure, postcode services and related digital services.
1.2 NDAPS Database means the postcode, address-reference, geographic, spatial, metadata and related datasets maintained, administered or made available through NDAPS, together with associated structures, classifications and data-management elements.
1.3 NDAPS Platform means the websites, applications, portals, APIs, databases, interfaces and technical systems through which NDAPS Services are provided.
1.4 NDAPS Services means the services provided through NDAPS, including postcode lookup, address validation, address standardization, authorized geospatial services, bulk processing and API services.
1.5 API means an application programming interface through which authorized systems may access specified NDAPS Services.
1.6 Content means information, text, data, images, documentation or other material made available through NDAPS.
1.7 Data Subject has the meaning assigned under applicable Nigerian data protection law.
1.8 Personal Data has the meaning assigned under applicable Nigerian data protection law.
1.9 User, “You” or “Your” means any individual or organization accessing or using NDAPS.
1.10 NIPOST, “We”, “Us” or “Our” means the Nigerian Postal Service.
2. Acceptance of terms
2.1 By accessing or using NDAPS, you agree to be bound by these Terms and Conditions and any applicable service-specific terms.
2.2 The NDAPS Privacy Policy and Cookie Policy explain how NIPOST processes Personal Data and uses cookies and similar technologies.
2.3 The Privacy Policy does not constitute contractual consent to processing where another lawful basis applies.
2.4 If you do not agree to these Terms, you must not access or use NDAPS.
2.5 Where a User accesses NDAPS on behalf of an organization, the User represents that they have authority to bind that organization.
3. Eligibility and registration
3.1 Users must have the legal capacity required to enter into a binding agreement under applicable law.
3.2 Organizations using NDAPS must ensure that individuals acting on their behalf are appropriately authorized.
3.3 Users must provide accurate and complete registration information and promptly update information that becomes inaccurate or outdated.
3.4 Users are responsible for protecting their account and API credentials.
3.5 Users must promptly notify NIPOST of suspected credential compromise or unauthorized account activity.
4. Description of NDAPS services
NDAPS may provide:
- Postcode lookup;
- Service delivery;
- E-commerce & logistics;
- Address validation;
- Address standardization;
- Authorized geospatial and location-reference services;
- Bulk address/postcode processing;
- Enterprise services;
- API access;
- Data-quality and correction services; and
- Other services introduced by NIPOST.
NIPOST may modify, restrict, suspend or discontinue all or part of NDAPS where reasonably necessary for:
- maintenance;
- security;
- legal or regulatory compliance;
- national security;
- public safety;
- operational requirements; or
- other legitimate reasons.
Where reasonably practicable, NIPOST will provide advance notice of material planned interruptions.
5. NDAPS data and reliance
5.1 NDAPS provides postcode, address and related geographic reference information for authorized purposes.
5.2 NIPOST applies appropriate processes to maintain data quality. However, postcode, address and location information may contain errors, omissions or discrepancies or may change over time.
5.3 Users should undertake additional verification where the accuracy of NDAPS information is material to a legal, financial, safety, regulatory or other high-risk decision.
5.4 Unless expressly authorized, Users must not represent NDAPS information as independent verification of identity, ownership, occupancy or another fact.
5.5 A postcode or address reference provided through NDAPS does not, by itself, establish ownership, title, occupancy, identity or legal status.
6. Licence and permitted use
6.1 Subject to these Terms and any applicable service-specific agreement, NIPOST grants an authorized User a limited, non-exclusive, non-transferable and revocable license to access and use NDAPS for lawful and authorized purposes.
6.2 The license does not transfer ownership of:
- the NDAPS Database;
- NDAPS software;
- APIs;
- postcode structures;
- documentation;
- trademarks;
- interfaces; or
- other intellectual property belonging to or licensed by NIPOST.
6.3 Users must comply with the NDAPS Acceptable Use Policy.
6.4 API Users are additionally subject to applicable API documentation, technical restrictions, license terms, pricing terms and data-use requirements.
7. Intellectual property rights
7.1 All rights, title and interest in and to NDAPS and its components, including the NDAPS Database, postcode codes and structures, software, APIs, documentation, algorithms, interfaces, designs, trademarks, service marks, logos and related materials, are owned by NIPOST or its licensors, except for third-party materials expressly identified as such.
7.2 No ownership rights are transferred to a User by accessing or using NDAPS.
7.3 Except as expressly permitted under these Terms or another written agreement, Users must not reproduce, distribute, modify, commercially exploit, publish or create derivative databases from NDAPS materials.
7.4 Use of NIPOST trademarks, logos or branding requires prior written authorization.
8. User submissions and data corrections
8.1 Users may submit address corrections, feedback or other information through authorized NDAPS channels.
8.2 Where a User submits information, the User grants NIPOST the limited, non-exclusive right to receive, use, verify, process, reproduce and incorporate such information to the extent reasonably necessary to:
- provide NDAPS Services;
- maintain NDAPS;
- verify and improve data quality;
- secure NDAPS;
- investigate misuse; and
- improve NDAPS functionality.
8.3 This provision does not transfer ownership of Personal Data and does not override any rights available to a Data Subject under applicable data protection law.
8.4 Users represent that they are authorized to submit the information provided.
8.5 NIPOST may review, verify, correct, reject or remove submissions where reasonably necessary to maintain the integrity, security or quality of NDAPS.
9. Data protection and privacy
9.1 NIPOST processes Personal Data in accordance with applicable Nigerian data protection law and the NDAPS Privacy Policy.
9.2 Depending on the circumstances, NIPOST may rely on lawful bases recognized under applicable law, including:
- performance of a contract;
- compliance with a legal obligation;
- performance of a public function;
- legitimate interests;
- consent where required; and
- protection of vital interests where applicable.
9.3 Users processing Personal Data obtained through NDAPS are independently responsible for complying with the data protection obligations applicable to their own processing activities.
9.4 Enterprise and API Users may be required to execute a Data Processing Agreement or other data-use agreement where applicable.
10. Fees and payment
10.1 Certain NDAPS Services, including premium API access, bulk processing and enterprise services, may be subject to fees.
10.2 Applicable fees, payment terms, taxes, usage limits and refund conditions will be specified in the applicable service agreement, order form, pricing schedule or other commercial terms.
10.3 Unless otherwise stated, fees will be quoted in Nigerian Naira and are exclusive of applicable taxes.
10.4 NIPOST may restrict or suspend access where undisputed fees remain unpaid after the applicable payment period.
11. Service-specific terms
Certain NDAPS Services may be subject to additional terms, technical requirements, pricing conditions, service levels or data-use restrictions. These may include:
- API access;
- enterprise integration;
- bulk validation;
- commercial data access;
- government integration;
- logistics integration; and
- other specialized services.
Where applicable, service-specific terms form part of the agreement between NIPOST and the User and prevail over these Terms to the extent of any inconsistency.
12. Third-party links and integrations
NDAPS may contain links to or integrations with third-party websites, systems or services. NIPOST does not control third-party services and is not responsible for their content, availability, security, privacy practices or terms. Users should review applicable third-party terms and privacy notices before using such services.
13. Disclaimers
To the maximum extent permitted by applicable law, NDAPS is provided on an “AS IS” and “AS AVAILABLE” basis. NIPOST does not guarantee that:
- NDAPS will always be available;
- NDAPS will be uninterrupted or error-free;
- all information will always be complete, current or accurate;
- NDAPS will satisfy every business or operational requirement; or
- defects will always be corrected immediately.
Nothing in these Terms excludes any warranty, representation or obligation that cannot lawfully be excluded under applicable law.
14. Limitation of liability
Subject to applicable law, NIPOST shall not be liable for indirect, incidental, special or consequential losses arising from use of NDAPS. NIPOST's aggregate liability arising out of or relating to NDAPS shall not exceed the amount expressly specified in the applicable service agreement or, where no service fee has been paid, an amount determined in accordance with applicable law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from fraud or other matters for which exclusion or limitation is prohibited by law.
15. Indemnification
To the extent permitted by applicable law, the User shall indemnify and hold harmless NIPOST and its authorized officers, employees and contractors against third-party claims, losses, liabilities, costs and reasonable expenses arising directly from:
- the User's material breach of these Terms;
- the User's unlawful use of NDAPS;
- the User's unauthorized processing, disclosure or misuse of Personal Data obtained through NDAPS; or
- Content or data submitted by the User that infringes the rights of a third party.
16. Suspension and termination
16.1 NIPOST may restrict, suspend or terminate access to NDAPS where reasonably necessary because of:
- a material breach of these Terms;
- security risk;
- suspected unlawful activity;
- legal or regulatory requirements;
- misuse of NDAPS;
- non-payment of applicable fees; or
- operational, national-security or public-safety requirements.
16.2 Where circumstances permit, NIPOST may provide notice before suspension or termination.
16.3 Upon termination or expiry, the User shall cease accessing NDAPS and cease using NDAPS data except to the extent continued retention or use is expressly permitted by an applicable agreement or required by law.
16.4 Where required by NIPOST or the applicable agreement, the User shall securely delete or return NDAPS data and certify deletion where reasonably requested.
17. Dispute resolution
The parties shall first attempt in good faith to resolve any dispute through negotiation. If the dispute remains unresolved for 30 days, the parties shall attempt mediation through an agreed mediation institution or procedure. If mediation does not resolve the dispute, the dispute shall, subject to applicable law and the authority of the parties to agree to arbitration, be referred to arbitration in Lagos, Nigeria, in accordance with the Arbitration and Mediation Act 2023. The language of arbitration shall be English. A party may seek urgent interim or injunctive relief from a court of competent jurisdiction where permitted by law.
18. Force majeure
NIPOST shall not be responsible for delay or failure to perform obligations to the extent caused by circumstances beyond its reasonable control, including:
- natural disasters;
- war;
- terrorism;
- civil unrest;
- epidemics or pandemics;
- government action;
- major telecommunications failures;
- widespread internet disruption;
- widespread power failures; or
- other comparable events.
19. Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable, where legally permissible, and the remaining provisions shall continue in full force and effect.
20. Waiver
No failure or delay by NIPOST in exercising a right under these Terms shall constitute a waiver of that right. Any waiver must be made by an authorized representative of NIPOST.
21. Assignment
Users may not assign or transfer their rights or obligations under these Terms without NIPOST's prior written consent, except where permitted by applicable law. NIPOST may assign or transfer its rights and obligations where permitted by law, including in connection with lawful statutory reorganization, restructuring or transfer of functions.
22. Changes to these Terms
NIPOST may update these Terms from time to time. Non-material changes may take effect upon publication. Where changes materially affect Users' rights or obligations, NIPOST will provide reasonable notice through NDAPS, email or another appropriate communication channel before the changes take effect, except where an immediate change is required for security, legal, regulatory or public-interest reasons.
23. Entire agreement
These Terms, together with the applicable Privacy Policy, Cookie Policy and any applicable service-specific agreement, constitute the agreement governing the User's use of NDAPS and supersede previous representations concerning the same subject matter, except where expressly incorporated into a written agreement.
